The Data Controller is WILLPOWER CONSULTANTS PVT LTD, based at F-43, Cosmos Square, Global City, Virar West, Mumbai 401303. We provide permanent and temporary recruitment services to clients looking to recruit personnel for their businesses. We also provide payroll services for contractors.
Who does this Privacy Policy apply to?
This Privacy Policy applies to the personal data of our Website Users, Candidates, Clients, Suppliers, and other people whom we may contact in order to find out more about our Candidates.

If you are dissatisfied with any aspect of our Privacy Policy, you may have legal rights and, where relevant, we have described these as well.
What does this Policy cover?

What personal data do we collect about you?
Candidates; We collect and use only the information necessary to be able to find the best available opportunities and any further information needed to assess your eligibility through the different stages of recruitment. This information includes CVs, identification documents, educational records, work history, employment and references and financial information.
We may also collect sensitive personal data about you, related to your health, diversity information or details of any criminal convictions of. We only collect sensitive personal data from you and further process this data, where you have given your explicit consent.Clients; We collect and use only the information necessary to provide you, or people in your organization with services such as finding the best available candidates for your opportunities.
Other data subject; we collect and use only the information necessary to be able to contact you and pay you for the services you provide.Website Users; We collect and use only the information necessary to improve your experience when using our website. This may include how, when and how often you visit us.
Where do we collect personal data about you from?
The following are the different sources we may collect personal data about you from:
• Directly from you. This is information you provide while searching for a new opportunity and/or during the different recruitment stages, or during the course of our work with you to ensure that our relationship runs efficiently. • From an agent/third party acting on your behalf. e.g. A Contractor’s Limited Company. • Through publicly available sources. For example; • LinkedIn • Job Portals (Naukri, Shine, Timesjobs, Monster, apna job, job hai etc) • By Reference or word of mouth. For example, you may be recommended by a friend, a former employer, a former colleague or even a present employer. Where we collect your information through publicly available sources as set out above, we may do this with the aid of recruitments programs’. These programs’ are given parameters on the requirements of a role and search through publicly available sources to find such candidates. These programs’ are designed to only output information on candidates that meet the search criteria. The parameters of this program are restricted to only searching for candidate information from public sites where there is a reasonable expectation that such information may be collected and further processed by job recruiters for the purpose of sourcing candidates for different job roles.How do we use your personal data?
Candidates; we use your personal data to match your skills and experience with a potential employer. We will initially collect basic information on you such as contact details, job role and experience and then pass this on to the client in search of personnel. If you are chosen by the client and go through to the next stage we will then be collecting more information from you at the interview (or equivalent) stage and onwards in that manner. We may use your data to send you information that you may find interesting such as suggesting other jobs to you.
Clients; we use your personal data to ensure that we can find the right candidates for the opportunities that you may have or for contractual obligations.
Suppliers; we use your personal data to ensure that we can contact you and for contractual obligations.
How long do we keep your personal data for?
We will only retain your information for as long as is necessary for us to use your information as described above or to comply with our legal obligations. However, we may retain some of your information after you cease to use our services, if we believe in good faith that it is necessary to meet our legal obligations, such as retaining the information for tax and accounting purposes.
When determining the relevant retention periods, we will take into account factors including:
(a) Our contractual obligations and rights in relation to the information involved;
(b) Legal obligation(s) under applicable law to retain data for a certain period of time;
(c) Statute of limitations under applicable law(s);
(d) (Potential) disputes;
(e) If you have made a request to have your information deleted; and
(f) Guidelines issued by relevant data protection authorities. Otherwise, we securely erase your information once this is no longer needed.
Who do we share your personal data with?
Candidates; we share your personal data with the client who has a position to fill, in order to determine with the client whether you are a good fit for the available position. We may also conduct checks on you to verify the information you have provided and where we do this we share your information with our appointed background checking company. Unless you specify otherwise we may share your data with any of our associated third parties - for example our payroll and pension providers – to provide you with the best possible service.
Clients; we share your data with candidates during the course of providing recruitment services to you, and with third parties as part of our contractual relationship.
Suppliers; we share your data third parties as part of our contractual relationship.
USE
OF THE PLATFORM:
The following actions will inter alia constitute a misuse of the Platform and are strictly prohibited:
Copying, extracting, downloading, sharing, modifying, selling, storing, distributing, making derivative works from or otherwise exploiting any content, data, information, including profiles, curriculum vitae, photographs and/or graphics, available on the Platform and/or any services or products of the Company, in any manner or for any purpose which is not, consistent with the Purpose and/or in accordance with the Terms of Use.
Users are expressly prohibited from using or exploiting the Platform and/or any content or data provided therein for:
Any commercial purposes such as creating alternate databases, extending access to the Platform to third parties without prior written consent of the Company; and/or
Undertaking any business activity which is in competition with the business of the Company; and/or
For seeking fees in any name whatsoever; and/or
Approaching candidates/jobseekers for any purposes other than for specific existing vacancies; and/or
Sharing access with persons who are not contracted with the Company.
What legal basis do we have for using your information?
For prospective candidates, contractors, referees and clients, our processing is necessary for our legitimate interests - we need this information in order to be able to assess suitability for potential roles, to find potential candidates and to contact clients and referees, and suppliers.
We carry out a ‘balancing test’ to ensure that our processing is necessary and that your fundamental rights of privacy are not outweighed by our legitimate interests, before we go ahead with such processing. We keep a record of these balancing tests. You have a right to and can find out more about the information in these balancing tests by contacting us using the details below.
If you are interviewed and submitted as a candidate, then this may involve the processing of more detailed personal data including sensitive data such as health information that you or others provide about you. In that case we always ask for your consent before undertaking such processing.
Where we need consent for some activities such as contacting candidates about other recruitment-related services we will ask for it. We rely on soft opt-in consent for these activities where you have previously engaged with us by submitting a CV, applying for a job, or registering on our website. This means we take you consent as given unless or until you opt-out. For other types of e-marketing we require your explicit consent.
What happens if you do not provide us with the information we
request or ask that we stop processing your information?
If you do not provide the personal data necessary, or withdraw your consent for the processing of your personal data, we may not be able to match you with available job opportunities.
Do we make automated decisions concerning you?
We may make automated decisions about you during the assessment stage of the recruitment process. We put assessment candidates through a structured screening process to assess whether each candidate meets the specific criteria for a particular position. These assessments may be fully automated e.g. online pre-screening tests. As these assessments may result in a candidate being deemed not suitable for a position by means of a solely automated assessment, we only undertake this activity with the candidate’s explicit consent. We also carry out personality profiling on candidates with the candidate’s consent.

How do we safeguard your personal data?
We take the security of your data very seriously and have put in place appropriate measures that are designed to prevent unauthorized access to or misuse of your personal data.

1. Identity information, such as your first name, last name, gender, username and/or similar as may be verified by voter ID card, PAN or driving license;

Professional information helps you to get more from our Services, including helping employers find you. Please do not post or add personal data to your resume that you would not want to be publicly available.
4. Feedback and correspondence, such as information you provide when you respond to surveys, participate in market research activities, report a problem with Service, receive customer support or otherwise correspond with us;
5. Usage information, such as information about how you use the Service and interact with us; and
6. Marketing information, such as your preferences for receiving marketing communications and details about how you engage with them.
SECURITY
OF LOG IN CREDENTIALS:
You are requested not to share passwords to your account(s) on the Platform with any other individual /entity and be responsible in what you post.
If you have registered on the Platform, the safety and security of your log-in credentials (i.e. your account access information and passwords) is your responsibility. You should not share your log-in credentials with any other person. You are fully responsible for all uses of your log-in credentials including all activities that occur under your account through the Platform. The Company, however, undertakes to take all reasonable precautions at its end to ensure that there is no compromise of login credentials provided to you.
xYou agree to immediately notify the Company of any unauthorized use of your account and/or log-in credentials.
LIMITATION
OF LIABILITY:
You expressly understand and agree that, to the maximum extent permissible under applicable law, company shall not be liable for any indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, revenue, goodwill, use, data or other intangible losses (even if you have been advised of the possibility of such damages). The company provides no guarantees of server uptime or applications working properly. In no event will company's aggregate liability to you for any claims, including under tort, contract or otherwise, exceed the amount of fees paid by you to the company. These limitations and exclusions will apply notwithstanding any failure of essential purpose of any limited remedy.
POLICY
APPLICABLE TO JOBSEEKER SOLUTIONS
By creating a jobseeker account on the Platform, you agree to :
Making your resume searchable to all Users of the Platform who subscribe to Database. You may be contacted by Subscribers via email, telephone and/or post. We recommend that you read the privacy settings carefully to make your profile accessible to recruiters/ employers as per your preferences. The Site will not be held responsible for contacts/mails received by you.
Your profile may be accessible with restrictions to unregistered users as well; however, they shall not be able to contact you.
Receive job alerts (messages detailing jobs that match your profile as entered on the Platform) via email/SMS or any other mode. You may remove yourself from the job alert database by resetting this option in the Privacy Setting section of your resume
Receive promotional mailers/ special offers/recommendations by the Platform on its behalf or on behalf of third parties. You may remove yourself from the promotional mailer database by resetting this option on the Privacy Setting section of your resume.
The resume/ insertion or information/data fed by you can be updated by you alone, without any additional cost, except for a few fields which are automatically updated by the Platform based on the information that is provided by you, in order to enhance your user experience.
You are advised not make any payments to any Recruiters and are further advised to check the authenticity of all or any response received pursuant to the resume/ insertion or information/data being fed into the network system of the Platform by you, prior to going out of station or in station for any job or interview. The Company assumes no responsibility in respect thereof and expressly disclaims any liability for any act, deed or thing which you may do, pursuant to the receipt of the response, if any, to the resume/ insertion or information/ data being fed into the network system of the Platform.
In case you have subscribed to Resume Writing services and necessary inputs required by us for commencing the services are not received by us within 30 days of the payment, the order shall stand cancelled and any amounts paid shall be appropriated.
Job
Alerts:
The Platform uses an automated algorithm to match jobs against the keywords/attributes present in the profile submitted by the user or based on the preferences set by a user, and hence offers no guarantee nor warranties that the jobs sent in the job mail will be relevant to the profile. You are advised to independently verify the authenticity of the credentials of the employers/recruiters whose profiles and or offers may be part of the Job Alerts (Mail or SMS)
The Company does not offers any guarantee that there would be a satisfactory response or any response at all once the job vacancy is put on display or for any responses received/contacts made through the our WPC database.
The Company shall in no way be held liable for any information obtained/received by you and it shall be your sole responsibility to check, authenticate and verify the information/response received at your own cost and expense.
Any actions taken by an employer/recruiter on the basis of the background check report or otherwise, are the employer’s/recruiter's responsibility and choice alone and the Company will not be liable in any manner for the consequences of such action taken by the user.
No fee shall be charged by the Recruiter from any person who responds to jobs advertised on the Platform. You further undertake to use the database to contact candidates for jobs only.
Under-age Employment
WPC – does not promote jobs for under-age employment. The minimum age criteria eligible should be eighteen (18), and above.
Charges

Please Note: We do not charge from Jobseekers & hereby we do not take any payments from jobseekers & hereby requested to jobseekers that do not provide OTP unless it is authorized from WillPower regarding the authorization of registration purpose only.
What rights do you have in relation to the data we hold on you?
By law, you have a number of rights when it comes to your personal data. Further information and advice about your rights can be obtained from the data protection regulator in your country.

information about how we use your information and your rights. This is why we
are providing you with the information in this Policy.

Fraud

WPC may also access and use your

be guaranteed to be secure from intrusion. However, we maintain commercially
reasonable physical, electronic device such as Firewall & DDOS to protect
your information.
All information you provide to us is
stored on our or our subcontractors’ secure servers and accessed and used
subject to our security policies and standards.
We use hosted servers in the course of
our business. Where we have given you (or where you have chosen) a password
which enables you to access certain parts of our site, you are responsible for
keeping this password confidential, ensuring it is secure and strong, and for
complying with any other security procedures that we notify you of. We ask you
not to share your password with anyone
INTELLECTUAL
PROPERTY RIGHTS:
YOU
ARE REQUESTED TO RESPECT OUR PROPRIETARY RIGHTS AND BRANDS
All rights, title and interest in and to the Platform including the intellectual property rights therein, which shall include but not be limited to proprietary database, trademarks, service marks, logo, copyright, know-how in and to the Platform, and any copies You are permitted to make herein, are owned by the Company and is protected by applicable laws. You are granted a limited, revocable, personal license to use and access the Platform for the Purpose, provided that you are at all times in compliance with these Terms of Use. Users shall under no circumstance sublicense, assign, or transfer the license, and any attempt at such sublicense, assignment or transfer is void. No rights are granted to you other than a limited permission to use the Platform upon the terms expressly set forth in these Terms of Use. Any misuse of the Platform or the Company’s intellectual property for a competing business or in any other manner whatsoever shall be actionable by the Company. The structure, sequence, organization and source code of the Platform are valuable trade secrets and copyright of the Company.
By opting to access the Site and use the services, you hereby acknowledge and agree that any information or material provided to the Company will be deemed NOT to be confidential and proprietary to you. By providing the Company any information or other material, You grant Company a non-exclusive, unrestricted, irrevocable, perpetual, royalty-free, worldwide, assignable, transferrable, right and license, in all formats or media, whether now known or hereafter devised or discovered, to use, reproduce, display, transmit, translate, rent, sell, modify, disclose, publish, create derivative works from and distribute that material or information, and You also agree that the Company is free to use any ideas, concepts, know-how or techniques that You send us for any purpose. You further agree that such license would not lapse in any circumstances, notwithstanding the provisions of any law in force, including without limitation, the Indian Copyright Act, 1957. You further agree to indemnify, defend and hold the Company harmless from any liability arising due to the use or distribution of any such material or information.
The above provisions and rights
granted regarding title and intellectual property rights associated with the
Platform shall survive termination of these Terms of Use.
